Violation with coronavirus could carry a prison sentence
jan roos, Covid_19, covid19, corona netherlands, corona symptoms, corona map, corona news, corona virus netherlands, fine corona violation, minister bruno bruinsThe government has taken several measures in dealing with the coronavirus. For example, activities with more than 100 people are banned. Schools and daycare centers must close temporarily. The same applies to eating and drinking establishments, sports and fitness clubs, saunas, sex establishments and coffee shops (only take-out is now permitted again at eating and drinking establishments and coffee shops). These bans can be adopted in so-called "emergency regulations" by chairmen of security regions. This has now been done in all 25 safety regions of the Netherlands.
Violating such emergency ordinances is punishable under Article 443 of the Penal Code.
The maximum penalty is imprisonment for up to three months or a fine of the second category (€4,350). The offense is a misdemeanor.
In addition, any directions given by authorized officials to implement these ordinances must be followed immediately. For example, the police may order you to reduce an event where more than 100 people are present to no more than 100 people. Consider a wedding or other organized event. Chances are that a (monetary) penalty will also be imposed immediately.
Apart from criminal law, administrative law can also be enforced. Think of an order under penalty, should a bar or gym not comply with a ban from the emergency ordinance.
We advise you to comply with the rules. But in case of violation, we are happy to advise you.
