The minutes of the court hearings held on appeal show that the accused invoked his right to remain silent and that the accused did not state anything at all about the ad informandum fact at issue here. Furthermore, counsel for the accused has only argued that "the ad informandum added fact (...) can be included in the punishment", but has not brought forward anything substantive on behalf of the accused about an admission by the accused of committing the ad informandum added fact.
