Child porn suspect free due to prosecutor's mistake (Telegraph.co.uk)

MAASTRICHT - A man from Weert arrested in October for possession of nearly half a million child pornography images was released Tuesday because the charges against the suspect were not made specific enough. The judge dismissed the prosecution's (OM) charges Tuesday. The prosecution announced Tuesday night that it will re-indict the suspect for the offenses.

The judge noted that despite case law, the prosecutor chose to describe only broadly what was seen in the child pornography images. Attorney Ivo van den Bergh explained that it is therefore unclear what the 50-year-old suspect has to defend himself against.

For some time, the prosecution has been using a global way of describing the facts, the so-called collection scan method. This means that no specific images are described as is common in a traditional method of indictment. The Prosecution rejects the court's position; after all, other judges did accept the scan method. Among them were judges in Limburg, the prosecution said.

The man was ambushed in Sittard during recordings of SBS6 journalist Alberto Stegeman's program Undercover in Nederland when he was promised sex with a young girl. At his home, the large amount of child pornography was found.
