In accordance with Mr. Koumans' defense, the claim for immaterial damages was rejected. The court understands that the injured party would like to recover these negative feelings from the perpetrator. However, the law sets strict requirements for recovering (from perpetrators) these negative feelings. Recovery is only possible if there is such mental injury that it can be considered an impairment of the person. This is only the case if the psychological consequences are sufficiently serious. Feelings of fear, terror, uncertainty, helplessness and nervousness do not fall within the scope of this article of law. Serious psychological harm, as referred to above, has not been alleged by the injured party. This post is therefore dismissed.
