Exoneration of murder/manslaughter shooting Cadier en Keer. However, the court finds these statements so unreliable that they cannot be decisive for proving that the defendant intended to kill the victim intentionally. The court therefore relies on the defendant's statement that he did not take the gun to shoot the victim with it. According to the court of appeal, it cannot be ruled out that the gun went off, as defendant has stated, because the victim pulled it, while defendant had his finger on the trigger. It is also conceivable that the gun went off three times in quick succession during the struggle without the defendant knowingly pulling the trigger. However, the defendant was sentenced for other offenses to imprisonment for three years.
