The court considers attempted aggravated assault proven. In the opinion of the court, there was an emergency defense situation, in which the violence applied by the defendant must be considered necessary and proportionate in the context of her defense. The defendant was physically attacked in her home by the victim who had previously shown herself violent toward the defendant. In the court's opinion, it was not possible for the defendant to evade the victim's attack by fleeing, or at least it could not be required of her. Therefore, the court comes to the conclusion that the proven attempted aggravated assault is not punishable. The appeal to self-defense succeeds and the defendant is therefore discharged from all prosecution.
